Three justices on the U.S. 9th Circuit Court of Appeals, who will hear oral arguments for the Prop 8 case today at 10:00 a.m. PST, are separating the discussion into two parts. For the first hour, they'll hear whether the proponents of the ballot measure, which repealed same-sex marriage in 2008, actually have standing to challenge the a lower court's ruling that Prop 8 was unconstitutional (this sort of challenge would ordinarily by left to the officials who would enforce marriage laws, but California officials refused to appeal the earlier decision). The second hour is reserved for each side to make a case about Prop 8's constitutionality.
