Man Ordered to Return Judge's Dirty Pics, Canadian Paper Manages To Track Down Non-Imbecile For Comment

This sounds about right:

Two days after shocking Manitoba’s legal world with claims that he was pressured to have kinky sex with a lawyer-turned-judge, Alexander Chapman was hit with a court order forcing him to return explicit photographs of the jurist. Chapman also found himself on the receiving end of a counter-lawsuit, alleging he violated privacy laws and a confidential settlement agreement when he went public with his claims.

And the Canadian press finally goes and gets a quote from someone who isn't a complete moron:

“Do we imagine that judges never disrobe or that judges never have sex lives? Of course they do,” said Bruce Ryder, an Osgoode Hall Law School professor who teaches in the area of judicial independence and ethics. Ryder worries that “prurience” and “moral prudery” will drive the debate over whether Associate Chief Justice Lori Douglas of the Court of Queen’s Bench of Manitoba should be removed from office.... [Ryder] believes if a judge isn’t involved in anything illegal or something that could give rise to a conflict of interest—such as a citizens’ crusade against city hall—their private lives should not be up for discussion. “We really have to start by asking ourselves, what exactly has Justice Douglas done wrong? Based on what we know so far,” said Ryder, “maybe she deserves our sympathy more than our condemnation, because it seems she has been the victim of an egregious invasion of privacy.”

Told you Canadians had stronger privacy laws and that this would come out in the resulting court cases.

See, it's a very different balance of issues there. Just because you're married doesn't mean you give up certain rights.

And they are enumerated rights. Not intangible ones like we have here in most states in the US.

@5, that's a violation of a settlement agreement her husband's law firm hoped would cover up the husband's violation of the judge's privacy.

Actually, other journalists here are on Justice Douglas's side. Most notably Christie Blatchford has a recent column in The Globe and Mail. I don't always agree with Blatchford - she's far too pro-cop for my taste (including falling for a ridiculous "protestors disrupted a dead soldier's return" story during the G20). But in this case she's clear-headed.

"Is he kidding? A judge's credibility depends on legal knowledge, fairness, experience and courtroom manners, not what he does with his member, or what she does with it."

Under Canadian law, Alexander Chapman is in deep shit. He's gonna lose the money he got in the settlement and is gonna have to pay much more.

Re Knowledge and Accountability:
It is possible Douglas femme fatale situation may actually be self-induced. She may have used King to promote her own fantasy, which in no way is against the law, READ CHAPMAN’S AFFIDAVIT:

If the affidavit is an accurate account, and if Douglas had knowledge of her husband’s client privilege, then based on professional standards, this case is clear and there will be possibly two retirements and one divorce in the ofting. , there is no innocence on anyone's party. In fact, if it is accurate, I believe the ‘questionable conduct’ whether private or public rests on both legal professionals. I have no doubt believing that a wanton woman of Douglas’ stature is the brains behind this stupid scheme that got so botched by the other stupid participant, King.

Chapman may be down the river without a paddle, because he is going to be characterized and discredited for a breach of contract, but if your read the affidavit there is evidence that King entrapped Chapman and when it was evident that this wasn’t going anywhere,... $25K was paid to reduce the possibility of photos being distributed. Douglas may not have known about the e-mailed photos, but she certainly did meet with Chapman (twice according to the affidavit),... and Chapman was encouraged and enticed on numerous occasions by both King and Douglas.

Because King was Chapman's Lawyer, Douglas had to know the relationship and cloaked or not, they both got caught by their own 'breaches' of misconduct.

It’s understandable King got sick,... he flushed his career and their reputations as upstanding legal representatives in a relatively small community.

Chapman’s greatest disadvantage is he doesn’t know the legal ins and outs to compete against the current legal slurs and character assassinations.

Chapman is guilty of breach of contract,... and that is the easiest piece of this to resolve.

Putting lives back in order after this fiasco will take years of therapy.
