Constance McMillen Update: On, Off, On, Off, On!

First Itawamba Agricultural High School's prom was on—but Constance McMillen wanted to take her girlfriend, so the school board called it off. Then prom was on again—but it was going to be a privately organized prom at a local furniture mart and Constance and her girlfriend were not invited. Then Constance sued to force the school board to un-cancel the official prom and school officials argued—under oath—that they had no choice but to cancel prom because the huge controversy that erupted after they canceled prom was such a distraction that they had to cancel prom in advance of the huge controversy that would erupt after they canceled prom. And there was no need for the school to un-cancel the official prom, school officials argued under oath, because some parents were hosting a private prom and Constance was definitely welcome to attend! The judge ruled the school violated Constance's rights when it barred her from prom but he declined to order the Itawamba County School Board to un-cancel the official prom because parents had organized a private prom and Constance was definitely welcome to attend! But when Constance tried to buy a ticket to the private prom she was told—surprise!—that the deadline for purchasing tickets had passed. Sorry! Then the organizers of the private prom started to worry that they might get sued, so... they canceled the private prom.

BUT!

The prom that was on, then off, then on, then off... is on again.

The Itawamba Agricultural High School’s parent-sponsored prom is back on, and it will now be held at the Fulton Country Club, the club’s manager said... It had originally been set for the Tupelo Furniture Market but was canceled Monday night, multiple parents confirmed. Parents would not confirm for the Daily Journal or Itawamba County Times why the event was first cancelled. Lori Byrd, who served on the parent organizing committee that planned the canceled event, told The Clarion-Ledger newspaper it was called off because, "there are a lot of people involved and they don’t want to get sued."

Imagine how much less distracted everyone in Fulton would be if the school had simply allowed Constance to attend prom with her girlfriend in the first place—no lawsuits, no Facebook pages, no angry emails, no legal liability, no New York Times editorials, no Ellen.

Stupid bigots.

Hopefully Constance's stand will make a whole lot more schools think before discriminating, "we don't want to get sued". Go Constance, Go!

Are they afraid the gay is going to rub off on the other kids or something? Really, it would have been better for everybody if they had just let her take her girl to the prom.

I really believe they were just scared two guys would want to come. You know how it is down south. Two girls kissing is hot! Two guys? That is just wrong!

This "controversy" is the only thing that would make any prom memorable. Proms suck. High School sucks. Ones life doesn't begin until one leaves high school.

@12 Please before slandering a whole community, a whole town, provide the date and news source that shows that Constance was the victim of violence. The school has a dress code ( as all schools should have ) and behavioral rules ( as all schools need to have . ) Having rules and expecting the students to abide by them while on school grounds does not constitute violence.

We've already dealt with the "dresscode" and "rules" issues. As several of us said, the court found that those rules were violations of McMillen's First Amendment rights. There's nothing further to argue on the matter.

@18 Actually no, I'll just tell you because it's interesting. Schools and workplaces have the right to require a dress code, but that dress code cannot be gender based as that is sex discrimination. No one can discriminate or require you to fit their expectations of masculinity or femininity, that infringes on your freedom of speech. Behavior rules cannot infringe on your rights. Constance's school can not require her to dress as a "girl" or not go with a same sex partner because their religious views do not trump her rights.

Hey Loveschild, if you want to live in a country that values spiritual beliefs over individual rights, I've got the perfect place for you!

Lovely Saudi Arabia! I bet you'd love covering every part of yourself but your eyes when you leave the house, never being able to go out in public without a male relative as an escort, not being allowed to drive, and being stoned to death if you're caught in the company of a man who's not related to you! Not to mention that you'll never be taken seriously or given a fair trial - because you're a woman!

You see, the Koran doesn't value women very much. But the Muslims in Saudi Arabia are very serious about the fact that they live in a Muslim state, so they don't see their treatment of women as being repressive, because that's what the Koran tells them to do.

But since you think a community's spiritual beliefs should be allowed to violate a person's rights, it sounds to me like you're in the wrong country.

@32: I was just thinking how much LC's whining reminded me of my time in the Middle East!

They have all kinds of laws to prevent the poor people from seeing anything that might offend their culture or spiritual beliefs. Neither LC or Constance could dance with their partners in public without being arrested.
