this is, of course, one of the largest problems with a fake starbacks. it's all style with no substance -- and the style isn't even sincere.
but, yes, a local shop could choose what artist to display. and i'm guessing a local shop wouldn't have to worry so much about a commissioned artist complaining about competing works (for many reasons).

This "other designer" sounds like a fucking tool. Since when do commissioned artists dictate policy once their job is done? Does Starbucks have this person on retainer or something?
Ideally, one of the 300 independent coffee shops on 15th will give her show a home and somehow highlight the fact that Roy Street Coffee is nothing but another Starbucks.
It seems obvious that it's the managers/baristas who are at fault. THEY know they work for Starubucks, even if the public doesn't. Working for a large corporation like Starbucks comes with advantages (insurance, benefits) and disadvantages. If you step beyond your usual job duties, you probably should make sure you get permission and you do it correctly. Being a curator is probably one of those things. Furthermore, the mural in this store was obviously painted by someone with skill not usually found in most coffeeshops. I wouldn't be surprised if there were some caveats in the contract between Starbucks and the artist. Exclusivity might've been one of them.
