"This has to be Oregon Gary's worst nightmare," writes Lurleen at Pam's House Blend. The lawsuit filed yesterday by the anti-gay backers of Referendum 71 has apparently been referred to King County Superior Court Judge Julie Spector. Says Gary Randall today on his blog:

A deep concern that we have is that Judge Julie Spector is openly homosexual and [an] activist. She is found on a list of openly homosexual elected officials. In her campaign to be elected to her seat in 2000, she was quoted in the September 13, 2000, edition of the Seattle Weekly, calling herself a "dyke". It is impossible to believe an openly homosexual activist judge could rule fairly in this case. We are considering our next step.

It's kind of scary that there's a list of openly gay public officials. This is really starting to feel like an inquisition. Have we learned nothing about persecuting groups of people based on a common factor they share?

So, according to Gary: if it's a "c"hristian judge, that judge will certainly be even-handed and fair, but since she's a professed lesbian there's no way she can be fair and.. what's the word... judicious?

I can't wait to see that asshole's motion for Judge Spector to recuse herself because she is openly homosexual. Imagine what they would say if the other side claimed that it is "impossible to believe" that an openly Christian judge could rule fairly. Fuckers.

I think everyone should take a deep breath and go read the comments on the list. Or, if you'd like, go read the very bottom of the Pam's House Blend post for comments posted by the bloggers who made the list.

Yes, Gary Randall is getting his information from white supremacists. Yes, they use the "n" word. Yes, Gary sources them in his blog post. Yes, these are indeed people who are assisting him by giving him information on openly gay public officials.

So, again, these people do not like you if you are not straight and white.

I'd say this sucks. If she rules against the 'phobes, they'll just spaz out that the gay conspiracy is out to get them. Much better to have a straight judge shoot them down, or just have them lose their damn referendum.

Then we can mention that Pidgeon, their lawyer, is a birther and has filed several suits to get Obama thrown from the white house.

@6 Exactly. I feel sorry for her. If she hands this case off to another judge, she's saying that her sexuality affects her decisions. If she decides (based based solely on the facts of the law) against Gary’s group, they’ll yell and scream about how she could not have been fair, since they’re trying to persecute her. If she decides to allow it onto the ballot, she’ll be yelled for not sticking up for her own rights. No matter what she does, she’ll draw fire.

It should be noted that either party to a lawsuit can file an affidavit of prejudice under RCW 4.12.050, effectively disqualifying a judge, so long as they do it before that judge has made any ruling in the case involving the discretion of the court. (As an example, setting a schedule for briefing an issue would not involve the court's discretion, but ruling on a temporary restraining order would.) I have never filed an affidavit of prejudice - few attorneys do, since by doing so you are stating that you/your client cannot get a fair trial in front of that judge, and as a lawyer you never know when you'll be in front of that judge again. But, Oregon Gary and his lawyer are not worried about damaging their reputations with Judge Spector, and are likely to file.

Of course, every side in a case gets to file one "Affidavit of Prejudice" automatically removing the Judge if you state that you believe you cannot get a fair trial in front of them.

I don't think Judge Spector will be on the file for long.

It would be awesome if they filed an affidavit of prejudice only to wind up losing in front of some straight white guy.

But I hope Spector gets to keep the case. I like to think of it as a sweet accident of history that she got assigned to it, and think it would be quite meaningful to get a decision from her. Plus, she's an experienced jurist used to high-profile cases - she don't mind a little controversy, and knows how to write an opinion that's hard to appeal from.

As much as this depresses me deeply, I'm still shocked that I'm not surprised. I so wish this news could surprise me. It seem equality is a precious pearl, that must be redeemed by shucking the oyster of fear/hate/and money to pay ones overdue taxes. Shit.

Since their motive looks more like drama to stimulate fundraising they probably will fight it out hoping for a straight appellate court panel of judges. The surprise will come when Spector’s ruling is upheld in appellate court.

The most enraging part of this is that they got her name from a published list. (White supremacist website or not, it's still published, a public record.) While they are trying to keep signers of their petition private. It seriously makes me want to punch something.

The most troubling thing for the anti-gay litigants is not that Judge Spector is gay. It's that she is one of the very best judges in the county. For that, they should tremble.

OMG, this is so typical! No matter what, if they don't get their way they will claim prejudice, that is their code of honor...PREJUDICE, so why is it so far fetched for them to assume that anyone who does not agree with them is prejudiced? That is the glue of their group, anti-semetism! I hope she completes this case, it is really going to be historic.

What will be fun to watch is the aftermath when Referendum 71 takes away all these 'rights' you gays think you deserve. It will be HILARIOUS to watch the meltdown in Seattle. OOOOOOOOooooohhhhh the crying... will be fun!!!
