Teen Raped In Juvenile Detention Files Suit

A teenage girl has filed suit against the Echo Glen Children's Center—a juvenile detention facility in Snoqualmie—and the state Department of Social and Health Services for failing to protect her from a guard who raped her in her cell in 2008.

According to the lawsuit, filed in King County Superior Court on July 28th, former part-time guard Robert Heath Fox "groomed" the teen in the weeks leading up to the assault. Records indicate Fox took photos of the teen girl and her friends—a violation of Echo Glen's policy—and escorted her to classes.

King County Sheriff's office investigation records show that Fox entered the teenage girl's room at Echo Glen on May 6, 2008, woke her up, handed her an energy drink, and left. Minutes later, he returned, stripped the girl naked, held her down, and raped her.

Fox pleaded guilty to first degree custodial sexual misconduct in March 2009 and was sentenced to eight months in jail.

The teenage girl—who, the suit says, now suffers from post-traumatic stress disorder, anxiety, and depression—is seeking unspecified damages in her suit.

This girl had a lot of these problems long before she got there, that's for sure. I taught summer school there a few years ago. I wouldn't go back for a million fucking dollars.

I think they probably only convicted him for statutory rape. That's what first degree custodial sexual misconduct sounds like. I'm not 100% sure, but I believe First Degree Forcible Rape is five years to life.

Am I right lawyers or have I got it wrong?

@6 - which, of course, if true, does not mean that this was any less traumatizing for her than it would be for a girl who didn't previously suffer from post-traumatic stress disorder, anxiety, or depression.

I've been following this case and this person has a history back in the judicial system since 2002. If in fact she has something wrong with her (Mental Issues) it goes back to her pre teens, long before Mr. Fox came into the picture. Her history indicates, "robbery, forgery, theft and lying to law enforcement" She was 19 when the alleged indecent happened in 2008. This news item makes it sound like she is some 13 year old kid. Just want to put out there how old she really is. When did this issue turn to rape? I agree with the person who wrote comment # 6. Now as far as the grooming statement, who was grooming who? This little slut needs some help. Working in the Mental Health field, sounds to me like she might have had personal history with her own FATHER. (read between the lines).

@12, I truly hope you do not work in the mental health field.....if so where? I would not recommend you or your agency to anyone. Why have you been following this case? Yes she was 13 years old does that mean its okay to rap someone if their over 18? Why was she at Echo Glen, isn’t that a children’s facility?

it seems as though the information needed to make a jugment of fox isn't in yet. i know two employees from the glen, and there is definetly a problem with the facility; YES, why was a 19 yr. 7 mo. old young woman allowed to be in a children's facility? WHY, after being incarcerated previously there, and obviously without success, why was she returned to the glen? the alledged victim, has a history dating back to 2002 and as recent at dec. 2008, four mos. after being released from the glen. in 2008, she commited 8 counts or burglary, theft, robbery, possession and consumption of substance and falsifing info to a public servant. well, she established herself, that she lies, she must have a fixation for money, since some of previous crimes included forgery. i believe the possibility of her finally finding a sucker to hang is very probable, since she had only been at the glen, that time, since the end of feb. 2008, and fox started working as a temp the first of mar. 2008. it certainly didn't take her very long to find someone with compasion for her situation, to, appear as though, to plot her course. when fox did his night checks, the alledged victim stated she had a bad headache and wanted her light off, which was not according to regulation, and was told no. after fox did rounds, bed checks, he checked on the young woman. she asked if she could have the can he was drinking and without thinking, he handed her the can. the only dna evidence was the saliva on the can, stupid as that was. so, in my opionion, as others have had, he should have ignored he headache, told her to suck it up , go to sleep, deal with it in the morning. it cetainly doesn't seem to have been worth the involvment. she just found a sucker for a law suit, god help her soul, and as far as fox, he will be marked for the rest of his life. in conclusion; the echo glen needs to be closed down; the counseling staff needs to be investigated; the young woman needs to get some serious help and stop being coddled; she also needs to appologize for falsifing info about fox.

If she has this Post Traumatic Stress Sydrome then maybe she needs to be put into the local VA hospital and see what TRUE PTSS really is! Very sad to think she would go as far as subject questions now to women who really do get raped. .I find this appauling! Coming from one who has been raped... She know's she wasn't! It's all about the money! Shame on her and whoever put her up to this! Use the states money for education and NOT for a witch hunt!!!

I was working at Echo Glenn at the time of this incident. Two prior incidents occured involving Heath
Fox. His Supervisor Brad Beach was told by two female co-workers that Heath Fox had made unwanted advances towards them. Brad Beach met with Heath Fox and asked him to stop but again didnt do anything about it (no investigation was conducted) and two weeks later there is a rape involving Heath Fox. It is common practice at Echo Glenn to sweep things under the rug by the administrators. All the administrators at Echo Glen should be held responsible for this incident from Superintendent Don Mead to Assoc. Superintendent Brad Beach. As the law suits go the one suit seattled questionable the female worker was as much to blame and was the male employee. As for the other suit that was filed as a piggyback in hopes of getting money. The second suit filed for sexual harrassent never occured towards Brad Beach's ex-wife Vickie Beach. I do find it strange that when the Heath Fox incident was reported his supervisor Brad Beach, Mr. Beach let him finish his eight hour shift before reporting it to any law enforcement aggency or releasing him from employment. SHAME ON YOU!!!!!

Let's go back to him once more...he's a prison guard with full rights to move about freely and not stick his dick in a prisoner. She's a prisoner with no right to leave. I agree with #14, why was a 19 yr. old with that much baggage in her past, still at a childrens facility?? Sounds like she did indeed find herself a scapegoat. This young lady (not child) with all of the shit in her past sounds like a very manipulative coniving person. I think she is much smarter that you all think she is. I don't believe a word of this as being RAPE!

For those of you who claim the victim to be a slut and liar, may I inform you that it is illegal for a worker to have any type of sexual relations with a prisoner. Also usually persons with "baggage" are more likely to be targeted as victims of rape rather than liars. How old is this man anyway? Prison rape is rampant in this country. I do not believe that prisoners "get what they deserve" mentality that so many feel. I feel this mentality shows a lack of morality this nation has. What about God and the love of Jesus. Why would anyone call another human a little slut. That is so disturbing. Why are you so angry anyway? Your heart seems to be hardened. I will pray for you. I hope that one day you will turn to Jesus. His love is so powerful. He will fill you with compassion and love for this girl, whether her accusations are true or not, rather than contempt.

Whether this girl was 13 or 19, whether this was consensual sex or not, doesnt preclude the fact that this guard broke the law and should be punished. and the fact of the matter is that it should be considered more of a crime if the young lady in question had those mental health issues before her abuse by this man. what a slime to prey on mentally ill ppl. Do those of you who have spoken so uncharitably about this girl have any clue what led to the issues that caused her incarceration? Do any of you realize how many incarcerated children have led a difficult life that has led them to this trouble?
do you not have compassion for the frailest of our society?

let me tell all of you something her criminal history is due to the system failing her from the start. As for that little slut your referring to is someones daughter and that would be my daughter! The way I see it your on the same level as Mr. Fox. For your information she didn't file this suit it was I her mother who pushed the suit. So maybe all of you should get your facts straight before you start making angry, hurtful, and damaging false statement about someone! Its obvious you should be putting your own lifes in check!

that is terrible that a place that is suppost to be so good for your child is so dangerous. their away from their home, placed in this facility were they should be safe and their violated....its a outrage this would happen. how do they know shes the only one its happened to thank u concerned parent

I think the mother needs to look very close at herself before blaming her daughter's criminal history on the system failing her. Yeah, the system sucks & what happened to your daughter sucks even more. But did her problems start with the system? Why did she get in trouble in the first place? I'm tired of people blaming "the system" for their own screw ups. Take responsibility for your failures as a parent!
