Jamba Juice Does Not Endorse Get Your War On

Posted by on Fri, Jul 24, 2009 at 5:16 PM

David Rees is winding up his week of complaints about Jamba Juice ripping off the Get Your War On style. (I wrote about the plagiarism earlier this week.)

Rees closes out his week with a great little press release from Jamba Juice that confuses the hell out of the issue:

We understand there has been some misunderstanding about the Summer Bliss campaign artwork and the comic strip created by David Rees due to the use of these clip art images. Jamba Juice would like to expressly communicate that the Summer Bliss promotion was not intended to imply any affiliation with Mr. Rees, Mr. Rees’ endorsement of Jamba Juice and its products, or Jamba Juice’s endorsement of Mr. Rees’ work.

Thanks for the clarification, Jamba Juice.

And for those of you in the comments who are angrily defending corporate rights to flagrantly bite the styles of smaller businesses and artists: Have a great weekend!

I will have a great weekend.

For the record, I also fully support the right of smaller businesses and artists to flagrantly bite the styles of corporations. If that's what you want to call it.

Corporations have the right to do whatever they want, and I have the right to lap it up like the witless little cur I am!

As a designer, the idea that "Get Your War On" is an original idea seems ridiculous to me -- I have seen this sort of concept a million times. In my world, there's no such thing as an original idea, just the ability to hide your sources well. So if Jamba Juice did something wrong, it's that they didn't hide their sources very well. And also, their "boost" options taste gross.

Doesn't Get your War On use clip arts?

Seems like Jamba Juice kicked post-modernism in the balls.

Dear Stranger,

Why are you watering down the definition of "biting"?

Sincerely,

How does this compare to sampling in music?
Where entire riffs, choruses, and solos are ripped off?

Or for that matter, quoting? Can you quote somebody who was quoting?

Is not the entire human experience based on the recycled experiences of our ancestors?

Where the fuck is Charles Mudede for a topic like this?

It is all a mystery to me.

You stole my clip art dude!

I thought the whole point of clip art is that anyone can use it for whatever they want.

Now Paul Constant has gone insane, too? At least we still have Schmader.

Could there possibly be any more absurd faux-populist uprising than that against more than one business using a design that isn't protected by copyright or trademark or is, in fact, original in any way whatsoever? Way to cement your irrelevancy.

You have a great weekend, too, Paul. Sorry we lost you.

We actually asked Mr. Rees to come up with a few panels on the idea "My New Bookselling Technique is Unstoppable". He liked the idea but never got back to us. I guess we should have just done it ourselves. [Kidding]
