The only thing I need to know about Jimmy John's is that Jimmy John himself is an asshole who donated $2,000 to the Bush Campaign in 2004.

You are going to like this. True story. It was the end of 8th grade, and my best friend threw a little party because his parents were away for a couple days. What kind of party can a 8th grader throw, you know? So only about over 9000 people showed up. 6 dudes...1 girl.

Just as you would expect, some crazy shit happened. This girl was a freak, but hot as hell. She would always have that seductive look on her face... the kind that gets you aroused just by looking at her. We were all good friends in school, but never really chilled outside of it. We were all about 14, and really sexually inexperienced. This girl however, has fucked at least 20 different guys. From the moment she walked in the house, we could tell what she wanted.

Oh, Meeps, it seemed so cool to write that, I'm sure, but without trying very hard, I can think of "unfair termination" claims under about 6 legal theories - and, yes, in Washington state. Should you ever be in the position to end someone's employment, I suggest you not be so flip with the "employment at will" presumption. Your employer could quickly receive something much scarier than a picket line - a packet with a summons and a complaint.

I work in WaMu tower across the street. I heard that Jason was fired for showing up to work smelling like booze, etc. And i agree that today was a horrible day to protest his "unfair termination"; downtown was dead today.

Picketing is not a conventional public visibility type protest but a request for support by boycott, both from customers and co-workers. The basic theory is that you can easily fire a couple of troublemakers but it’s a lot harder to fire everybody. Usually when you’re picking a day to go on a short picket the best day is a Friday when everybody wants to play hooky anyway. This is why most construction labor agreements end in the summer.

i'd just like to point out, as a rule, people who have to take situations like these to picketing/boycotting/etc. usually do it because they know they can't/couldn't win the case in any court. probably because he's wrong, he knows it, and he's trying to bully the owner into giving him what he wants...just saying...

There's a difference between a legal termination and an unfair termination. Just because it's legal to fire someone for any reason in WA doesn't mean it's right. In this case Jason was fired for "smelling bad" on the whim of a manager, despite the fact that he was a bicycle delivery guy who has to ride around constantly and his request for an additional uniform was denied (he was told he should hand wash his uniform every night instead).

We are trying to send a message to managers that they will have to think twice before they fire someone on a whim or because they are in a bad mood - regardless of what the law is, they will face greater inconveniences when ex-employees and their friends fight back.

In any case a picket can prove more effective and much faster than using the legal route - a previous picket at Pita Pit in the U district cut sales by 90% at peak lunch hours.

This picket was carried out by Jason with the support of Seattle Solidarity network - www.seasol.net

Please help us support our friend Jason by NOT EATING JIMMY JOHN'S.

Recently a visiting JJ's executive walked by Jason, a hardworking bicycle deliverer, and didn't like the way he smelled. He noticed a whiff of last night's beer and cigarettes, which Jason had been sweating out through hours of hard pedaling. With barely a word, just for that, he casually had Jason fired.

The truth is it's not our friend that stinks, it's this kind of arrogant, heavy-handed corporate management which casually throws a worker out of his job on a whim.

We are now calling on management to correct this injustice, either by reinstating Jason, or if they can't do that, then by providing him with a modest severance pay. So far, they have refused. As long as this continues, please DON'T EAT JIMMY JOHN'S!

It does seem kinda ridiculous to fire a bicycle delivery boy for stinking. On the other hand, if his sweat actually smelled strongly of beer, perhaps he should ease up a little before work days. I don't want my sandwich coming from someone who smells like a hobo.

I do think this would have been best handled by writing him up, though. If Matt A's take on the story is roughly true, the response to Jason's error in judgment seems a bit extreme.

Damned if I'm going to sit by while heavy handed managers continue to stomp on regular working people like Jason. Hell, that could just as well be me. I sweat pretty bad when I ride a bike. I'll buy my sandwiches elsewhere for now.

the real story is the conversation the picketers and todays sandwich buyers are having during this protest. my smoke break was fun. Sorry you lost your job jason. If I was a sandwich deliverer I would be drinking like a fish. Fuck that job!

According to the state:

" If the employer requires more than one outfit meeting the definition of uniform, then the employer must incur the expense for all. When garments that by their design, use, or fabric, require frequent and special care and consequently indicate the need for more than one outfit, then the employer shall be responsible for the acquisition of at least two of these outfits. Workers that request more than one uniform of the wash and wear variety for their own convenience will bear the expense of additional uniforms."

Due to use, it looks like 2 uniforms were required. However, both parties should have invested in the future employment. Jimmy John's could have been nice and purchased several. Dude could have also purchased more uniforms if he cared about his job. If he was drinking, he shouldn't have been wearing his uniform. If it was his sweat than he wasn't following basic hygiene requirements which were probably referenced during the hiring process. I assume if he had a good working relationship with his manager this could have been figured out. Regardless of whose fault it was, It is more than likely that there were previous concerns. Also, plenty of people wash their work clothing multiple times a week. Use the sink or shower (I prefer the shower) and hang dry if you don't want to deal with the time and cost of a laundromat or home machine.

Jimmy Johns was nicer. We provided his with two riding jerseys and a regular cotton tee-shirt to wear. He constantly was smoking while taking deliveries and you can see him outside smoking during his picketing efforts. He was chastised for this and many other offenses in his stint as a delivery driver. And he used to brag about his nightly binge drinking at work the next day, so that clearly explains why he was sweating out alcohol while working.

He was overpaid on his last paycheck, due to an accounting error, and actually owes the company $52. He talked to the accountant and claims that he now understands this issue. More humorously, however, is that he wants his job back.

And our other drivers smell amazing.

You can't show up to work drunk or smelling like booze. Bottom line. I don't know why any employee would expect to be handled any differently than the way he was. If Jason was truly the "hard worker" he claimed to be his management would have recognized his abilities and taken more appropriate measures. Call it the straw that broke the camel's back. He is in a customer facing position which is a reflection on the entire company he works for (including himself). It was mentioned earlier and I agree, I don't want the person delivering my food smelling like alcohol and/or cigarettes. It's food.

Who are these protestors really affecting? Ask any of the friendly and hard working employees that work in the store on the 3rd & University that are getting their hours cut. If Jason had a real gripe (and any legs to stand on) he needs to go about it by approaching management and the company's HR department as a professional.

Jimmy John's will remain one of my favorite lunch stops in downtown Seattle and I wish all of it's truly hardworking employees the best. You're doing a great job.

Jason wasn't drunk at work you idiot, and the protests are mainly affecting the owners profits. The management is responsible for choosing when to cut employee's hours, so it is the management's fault for not responding in a more sensible way to the pickets. Your servile mind wouldn't be able to handle looking at things from any other point of view than a "professional" corporate ass kissing one though.

Also the statement by JJ about providing a change of uniform is simply untrue.

I find it funny that people lie through there teeth just to try and save face. I was only issued one t shirt when employeed,my hygiene was not the issue, the single work shirt was. I worked at 2 different locations a total of 6 days a week, washing my shirt on sunday with the rest of my laundry. I shower everyday so the offensive smell was built up from me working hard every day. Its easy to pick on me and give me shit, but what about assistant manager rachel an employee bob buying and selling extacy pills in the store. rachel also smokes before after and durring her shift as a lot of employees do. Double standard....of course. Several employees have even bragged about drinking on the job, not to mention getting high and selling pot. I had the decency to wait til my own time. So fuck jimmy johns management, and let them keep creating lies. They know how to get a hold of me

Jimmy Johns is pretty notorious for treating their workers really badly. I've had a lot of friends work for them and I've heard some pretty bad horror stories. Unpaid medical bills for bike delivery riders injured on the job, unpaid back wages (appearantly they get a lot of "accounting errors" down there), and just plain old harrassment by management.

I'm glad someone is finally standing up to them.
