King County Prosecutors have filed charges against a 65-year-old Seattle man for allegedly attempting to kidnap a five-year-old boy from the Pike Place Market.

According to police records, a California couple and their three children—ages 5,6 and 7—were walking through Pike Place Monday morning, when they stopped to remove a rock from the mother's foot cast. When the parents turned around, their 5-year-old son was gone.

The mother spotted 65-year-old Robert Steiner walking through a crowd with the 5-year-old boy, and began chasing him.Steiner let the boy go and was later found by police near the market's bathrooms.

Police records say Steiner told officers he was at Pike Place to catch a bus, and had stopped at the market to use the bathroom. Steiner claims the 5-year-old grabbed his hand and believes the boy had "mistaken him for one of his mother's friends."

When officers asked Steiner if he felt he'd done something wrong, he said "Ya, a 65-year-old doesn't walk with a 3,4,5 year old kid." and told police he had "no bad intentions at all" towards the child.

When police asked why he didn't stop and talk to the boy's mother after she chased him, he told officers "I don't really know, I had to go to the bathroom pretty bad."

Steiner has been charged with second degree kidnapping. The maximum sentence for second degree kidnapping is 10 years, but with no recent criminal history, Steiner will likely face 6-12 months in prison.

According to court records, Steiner's only prior criminal history is a 1987 conviction for attempting to elude a police vehicle.
