Someone had me check out Scott Horton's much more comprehensive, nuanced and authoritative piece "Justice After Bush" in the December Harper's. (Krugman prolly read it recently too - wink wink!) Srsly great work.

There's a great alternative to bogging down the administration with an investigation: open up as many documents as possible for research and let the press, expose authors etc. do that.
This isn't Nixon we are talking about. This is the worst presidency since Warren G Harding's and a toss up with his and Adrew Johnson's for the most corrupt ever. It won't take an independent investigator to expose it.
Mmm, yeah, I read it this morning. Problem is, what Krugman thinks doesn't matter much. What Obama thinks does, and he just wants to kick the shit off his shoes and move on.

@6, has the best idea, do we really want to bog down the federal government with a full on investigation, which like Krugman stated is going to result in claims of partisanship. Don't get me wrong, I think these people should pay, but I sincerely doubt the ability of congress to multitask an investigation and revitalizing the economy, those people can't walk and chew gum, hell, they didn't have an investigation ongoing and they still managed to screw up the first half of the TARP funds. Let the historians try them, not congress.
I think any attempt to prosecute the Bush Administration's crimes will go down in flames, at least early on in Obama's presidency. Right now it would turn into a hugely politicized issue and drive an even bigger wedge between the Repubs & Dems - which is *not* what he wants to do right now.
I think he actually wants to get some shit done. Maybe in a year or two they can reopen this - I'm sure they won't just let it fade into the sunset though.
Krugman says the biggest scandal of them all is that Bush lied to get us into Iraq? That's not the biggest. The biggest scandal is that the Republican Party and Bush's cronies and backers lied, cheated and manipulated the electronic vote to get him into the White House in the first place, and then four years later did it all over again, and it still has not been investigated in any meaningful way. That's the biggest scandal -- all the others follow from it.
Not prosecuting means we're begging a whole new generation of future "leaders" to be 1,000 times worse since they know that can violate all laws without consequences.
Remember when everyone thought Nixon was the worst president of their lifetimes?

@13 - that's why you need an end run around it - you do it throught the Hague and we can't stop it once they visit anywhere in the EU or a nation that delivers war criminals there.
Just as we did with Serbia.
May take a while, but makes it impossible for us to pardon them.
The biggest scandal of all was whatever Monica Lewinsky's father did to her to make her want to get her "Presidential kneepads" and go after Clinton who after all could hardly be expected to resist such a paragon of feminine pulchritude, which put the 2000 election within grasping range of the repugs' illegal manipulations, which led to the 9/11 attacks and Bush's use of that to justify invading Iraq with hundreds of thousands dead and a tits-up world economy...
Oh wait, the biggest scandal is failing to make the right choice of what's on your plate right now to ensure a better tomorrow.
- Prosecute Democrat Thomas Jesserson, in absentia, for miscegenation;
- Prosecute Andrew Jackson, Democrat, for genocide. Jackson lied and people died on the Trail of Tears;
- Ditto Democrat Polk who, Lincoln said, lied about the origin of Polk's preemptive unilateral war against Mexico;
- Get Democrats Pierce and Buchanan for getting us mired in the quagmire of Kansas insurgency and civil war elsewhere;
- Prosecute Democrat Grover Cleveland for sending goons and the 7th Cavalry to kill workers at Haymarket;
- Prosecute Woodrow Wilson, Democrat, for resegregating the exec branch after Republicans integrated it. Prosecute Wilson for prosecuting Americans (10 year terms for criticizing Wilson) during wartime and for unleashing a reign of terror after the war;
- Prosecute Democrat FDR for torturing American citizens in concentration camps. Ever been to Powell, Wyoming, in winter? Way worse than waterboarding;
- Put away FDR for killing antilynching legislation; for trying to pack the Supreme Court with cronies; and for putting a lifetime member of the Klan on the Court;
- Prosecute FDR for paying farmers to destroy food while "one-third of a nation" was going hungry;
- Prosecute FDR, in absentia, for destroying the livlihoods of black sharecroppers in the South;
- Prosecute FDR for his tenure as undersecretary of Navy. He said he broke so many laws and cut so many corners he could have been put away for 999 years. Should have been;
- Prosecute Truman, Democrat, for nuclear genocide against the Japanese;
- Prosecute Truman for allowing Acheson, his secretary of state, to foment the Korean War in which almost 40,000 Americans died and millions of Koreans died;
- Prosecute John Kennedy, Democrat, for sending more than one thousand freedom fighters to die or to be tortured by Castro. Kennedy lied about air cover, and people died;
- Prosecute Kennedy for conducting foreign policy through the Mafia;
- Prosecute Robert Kennedy, Democrat, for wiretapping Martin Luther King;
- Prosecute Democrat LBJ for turning Kennedy's Vietnam disaster into a debacle;
- Prosecute Johnson, in absentia, for getting rich by manipulating FCC licences;
- Persecute Jimmy Carter, Democrat, for being a fucking idiot who turned the Islamic Middle East into a cauldron;
- Prosecute Carter for building bad houses that fall down;
- Prosecute Carter for his policy of pouring food into gas tanks, and for the current famines his idiot policy caused;
- Prosecute Bill Clinton, Democrat, for raping Juanita Broaddrick and for molesting Kathleen Willey. Let them have their days in court and let him quit hiding behind statutes of limitation;
- Prosecute Clinton for being AWOL during the Cole, Khobar Towers, and the blown-up embassies;
- Prosecute Clinton for not taking bin Laden when OBL could have been extradited from Sudan;
- Prosecute Clinton for spying on Amicans via projects Eschelon and Carnivore;
- Prosecute Clinton for outsourcing torture via extraordinary rendition;
- Re-try Sloppy Sandy Berger, Democrat, for stealing and manipulating evidence in an apparent effort to mislead an inquiry;
- Shout down Clinton, Richard Clarke, and the Air America turd this morning who said careful Democrat planning caught Ahmed Ressam. Ressam was nailed only because he was fortuitously profiled;
- Prosecute Clinton et al. for allowing the 9/11 plot to fester to fruition on their watch;
- Blow off Paul Krugman whose columns in October 2001 were predicting an immediate liquidity trap that didn't happen. You say he presciently 'predicted' stuff back then that didn't happen until 2008? I say J.Z. Knight could have done at least as well, or that Krugman talked down our resilient 2001 economy, planting the seeds of the 2008 recession. Fuck him.
Almost forgot: We really need to get serious about Merry Fitzmas ... cleaning up the Democrat culture of corruption in Illinois that incubated Rezko and Obama. And about bringing 'Fingers' Richardson to justice in New Mexico. And tax cheat Geithner? Where's the outrage? And why, why would you permit as Secretary of State someone whose Big He has grown very rich by squeezing money from Middle Eastern kleptocrats?
