However, Occupy, because it based itself firmly in the trippy mind screws of the 1968 movements, refused to state what it was for or what its goal was. Therefore it not an "assembly" as in "assembling" or building something out of human ideas, but just a motley crew of diffident losers.

Actually, it is. The slate of amendments presented to the states on September 25, 1789 had twelve proposals. The first proposal revised the apportionment of the House of Representatives; it has not been ratified and is still technically before the states. The second proposal required an election of the House of Representatives before any change in Congressional compensation could go into effect; it was finally ratified in 1992 as the 27th Amendment.

What became the First Amendment was actually the third item presented to the states. That it became the First Amendment was purely coincidental. I would expect a legal scholar to know that.
