There is no reason for this man not to be charged with a much more serious crime, and serve a very long stretch of time in prison.

again, as a person who grew up with firearms, here are the rules:
1- a gun is always loaded- you always assume that to be the case
2-you never handle a gun except to clean it or fire it- if you are childish enough to 'mess with' or 'play around with' a gun, you are too childish to handle it.
3-you always control your muzzle.
4-you are responsible for your gun. There are no accidents, only carelessness and mistakes.

Because we cannot assume that everyone had a parent teach them this code, it is completely reasonable to have a safety class as mandatory before the purchase of any firearm. When I was 14 took a 20 hour hunter's safety class, complete with 6 hours of range time and practice doing dangerous things like crossing fences and loading guns in and out of vehicles- it was time well spent, and seems like a completely reasonable thing to ask of people.

Typically, the crime is a misdemeanor, unless the victim is under the age of 12, according to the crimes code.

@6: Children who have two adults caring for them tend to do better than those of single parents. Two biological parents would be nice, but the step-parent is better than nothing. (Don't believe me? Look it up. That's how the burden of proof works according to you.)

It used to be we'd let drunk drivers kill people -- kill their own kids -- and let them off because they meant no harm, and of course they're always "absolutely devastated".

But then we started throwing them in jail. Drunk driving declined. Drunk driving deaths went down. Clearly, drunk drivers are not as "devastated" by killing as they are by having their ass in the slammer.

Jail time makes all the difference, whether it's drunk drivers or fuckheads with guns.

So, a mere 6 business days after the shooting, charges were filed. You do know it took 10 days to charge the guy robbing people on metro buses at gunpoint... with videos and no coroner's reports to worry about.

@4: I have a story for you.

I used to be a judge for Magic: The Gathering. I worked closely with Rob Dougherty, and so when the http://en.wikipedia.org/wiki/Vs._System came out, Rob asked if I would help judge one of their "10k" tournaments (so named because of the $10,000 of total prizes). The game was very new, and many of the people there were new to the concept of card game tournaments where you could win money. We had some other judges as well, but I was probably the most experienced with judging tournaments from my experience with Magic. Near the end of the open portion of the tournament (before the elimination rounds) comes a time when certain matches matter, but only to one of the two people, in the sense that player A could make it into the elimination bracket, but player B can only prevent them from doing so. In one of these matches, we had a clear case of bribery, with player A offering player B compensation for conceding to him. In all tournaments of this sort, this is considered a Very Bad Thing(TM).
I found out about this, and told the head judge that we obviously had to disqualify player A. The head judge was resistant, saying "I know him, he screwed up, and won't do this again, we don't need to disqualify him." I replied "If you give him a lesser punishment, he may never do it again. If you disqualify him, nobody here and none of his friends will ever do it again."

We need to stop accepting that this happens. We need to start throwing the book at people. Ultimately we can't trust gun owners to learn safety without an outside influence. Give him community service and he learns his lesson, perhaps. Throw the book at him, and keep throwing the book at people like this, and the culture of "well, shit happens" will turn into "what the fuck is wrong with him?"

If having his newborn child in the same room wasn't enough incentive for him to take more care when "messing around" with his handgun, I can't conceive of anything else short of prison time (and being stripped of his right to own a firearm ever again) to drive the point home.
