Not that this isn't entirely stupid legislation, but a particularly stupid aspect of it is that a significant portion of birth defects that can be detected in utero are likely to result in stillbirth or very early death. Not to mention hellacious levels of misery all around.

If you're actually "pro-family," and a woman wants a child, which makes more sense? Pick one:

a) Force, coerce, or deceive woman into wasting 9 months of her life, nutrients, blood and energy bearing a doomed fetus.

b) Give her whatever medical care gives her the best chance of bearing a healthy child, and if things are going south, a chance to restart as soon as possible.

Every logical, sane person would choose the latter. WTF is wrong with these people?

The answer to preventing all pregnancies - and thereby eliminating any need for birth control or abortion or any doctor liability regarding disabilities in unborn babies, etc. etc. etc. is to simply cut off all penises. No penises in the world = no problems with pregnancies. Makes sense to me. About as much sense as the rest of this bullshit.

Actually, @16, it's significantly more liberal than it used to be. There's been a tremendous influx of Californians over the last 20 years or so, which is how people like Gabby Giffords could get elected. That would have been unthinkable not that long ago.

The liberals are still in the minority statewide, though, and the old-timers don't like them much, to say the least. Interesting dynamic going on there if you pay attention.

I live in her district and have sent letter upon letter to her office. Voted against her in the primaries. Rallied at the capitol. It's pretty hopeless here for women.

Gabby Giffords represents the district that includes Tucson; look at any political map of Arizona, and Tucson is a lone, tiny speck of blue. It's a college city full of Portland expats, not Californians. Check Scottsdale if you want to find them.

@21 AZ is not more liberal now than it used to be. 20 or so years ago, we had a Democratic gov (Babbitt), a Dem in the Senate (DeConcini), and Dems ruled most of the urban legislative districts. Even our GOP govs back in history (save Mecham, who was booted) weren't as nucking futs as the current thing running AZ (into the ground). Now Flagstaff and Tucson are about the only bastions of sanity in the whole fucking state. My father was in the house as a moderate Republican in Maricopa County - he didn't feel the need to interfere with a woman's uterus, he supported public schools, and he worked with people in both parties to pass legislation. Then he was ousted because he wasn't Republican enough. AZ is duking it out with UT and TX to be the worst state in the union.

By the way, is there anything in the constitution or in higher-order federal regulations that this law would be incompatible with and might them be grounds for a judge striking it down? Does anybody happen to know?

Dan, you read my mind. Every time something like this comes up, I think about rioting. They are really turning up the heat on women and it's terrifying. There are two anti-abortion bills here in Minnesota too. One state senator just made a statement saying that the birth control mandate is like "making the car insurance company pay for your windshield wipers". The local Planned Parenthood chapter sent out an email asking, "if birth control is windshield wipers, what is Viagra?" (My answer: Viagra is like the Garfield with suction cup feet. Just for fun, and ultimately serving no real purpose.)

They already have these laws in several states; Arizona is not the first. Idaho, Utah, South Dakota, Minnesota, Oklahoma, Arkansas, Missouri, Kentucky, Michigan, Pennsylvania, North Carolina, and Georgia.

The Oklahoma "Wrongful Birth" law also makes it where disabled or adopted children can't sue their parents for either cruelty or abandonment.

Well, according to Barto's fact sheet on the bill, 9 other states already have something like this on the books ( nancybarto.com/wordpress/?page_id=21). Anyone know more? The fact sheet questions the idea that a disabled child's life is worth more than a healthy child's life. Yet again, the Conservatives pointing out that the mother's life is worth the least of all.

Well, they couldn't have picked a better time to start doing this shit. The feminist movement has all but disbanded due to lack of support from even their progressive liberal peers for the last fifteen years, and feminism's been largely derided by practically everyone since the 90s.

How about Indiana? A woman is being charged with murder because she tried to commit suicide when she was pregnant and her fetus died. She will be in jail for a year on March 14. If convicted (no, she hasn't had a trial yet), she faces 45-65 years in prison.

I did a little more research on this, because I wasn't hearing anything about it from Planned Parenthood, and you know they'd be all over it. This article is somewhat misleading.

The bill does not permit doctors to intentionally withhold information, or to be grossly negligent. A nice way of reading it is that the doctor can't be sued if he/she unintentionally makes a mistake or read an ultrasound incorrectly, etc.

Of course, interpretation is 9/10ths of the law, and this can be interpreted a variety of ways. And the war against women goes on.

@49, I read it a little differently. Doctors can withhold information, they just can't be sued on the claim that somebody "would not or should not have been born."
So they're liable for all damage to the pregnant person still, which is good. Dan, this makes your quote inaccurate.
Not saying it's a good bill, just that it's not as bad as it's being described as, and accuracy will help us win.

Irrespective of what this insane piece of legislation says, wouldn't a doctor who actually did this be struck off by the Medical Board, or whatever equivalent you guys have over there? The fact that they couldn't be sued for it still would not make it ethical, right?
