I'm really glad to see this. My absentee ballot never arrived and I had to cast a provisional ballot. Talking to the volunteer at my polling place, it seems that a lot of absentee ballots never arrived to our little section of La Jolla and a lot of provisional ballots were cast there. I want my no vote to count.

That's nice that you're trying to cheer me up, but it's a done deal. The SF Chron says Prop 8 passed, and they're hardly on the "YES" side.

I'm really sad and ashamed about this. Other women at my office got married at the same time I did, and their marriages are gone and mine stays. Why? Because I married a man and they married women. It sucks.

Thanks, bigoted fuckers, but my marriage didn't need protecting.

Yes, but sfgate.com (the san francisco chronicle) is calling it. 8 Won. Last night, at the Westin in SF, I held my boyfriend, who is Mexican, (who is waiting to find out if he will get his green card). We celebrated with all the other fags, Obama being elected. But I couldnt shake that I still felt and still feel sad that 8 had so much support. We live in a bubble in the Bay Area. I stood outside all day yesterday handing out cards and waving a No on 8 sign in Berkeley and got hundreds of high fives, honks, smiles and nods of support. Yet, how it is here, is not indicative of the rest of the state.
B brought up the thought that he prefers that we are not acknowledged. We are the fringe, and we dont need to be validated by anyone else for our love to be legitimate.
I understand that the legal arguments to this fight as well....
I dunno....its all really just overwhelming.

Well, I am one of those Absentee votes voting against. They'd best be counting mine.

The concept of "restoring" something by ELIMINATING RIGHTS is absurd.

I voted early at city hall, along with about 20,000 others, which I believe will be counted later as provisional ballads.

Sadly though, I think Prop 8 will pass. The record turnout that help elect the right man to President is also a voting base not entirely ready for this. Moreover, though I think the Bradley effect was something of a myth, I think there's a very real analog for what happened with Prop 8.

The Supreme Court should strike this down. But then, we've got 50% of the voting base feeling there votes don't count. It's a shame all around. Fuck the Mormon Church. Fuck them.

If you're serious about getting married, you should do it in Massachusetts. Any marriage there will continue to be valid.

It's unclear what will happen to existing marriages in California. My partner of eleven years and I got married in San Francisco last week, and now our relationship is in legal limbo. We went from being "married" yesterday to "not sure" today.

Prop 8 isn't clear about it invalidates our marriage retroactively. It will take years for the courts to sort this out.

Also, it might be too late for you to get married in California, regardless. Once Prop 8 is certified, it might apply to all marriages after election day.

If you MUST get married in California, pick a county other than San Francisco, where the staff is swamped and you need advance reservations. You'll also need to find a county where the clerk's office is open on the day you pick.

Otherwise you can choose to do it privately, such as through the the Heart of the Castro wedding chapel. They can do "rush" wedding licenses through a notary.

But again, if this wedding is important to you, don't do it in California. It's not worth it. 52% of their population hates gay people and says that your relationship is not entitled to respect.

I guess I shouldn't be surprised at a conservative's complete and utter ignorance on the topic of constitutional law. Prop 8 amended the California constitution, which means there are a limited number of things that can change it. They are:
1. The voters get to vote on it at a later date and overturn it by a simple majority.
2. The California House and Senate overturn it with a two-thirds majority, unlikely to happen since same sex marriage legislation previously passed with only 53 percent support.
3. The U.S. Supreme Court overrules the California constitution, plus many other state constitutions, under the 14th Amendment with the same precedent as Loving v. Virginia.
4. The U.S. House and Senate plus two-thirds of the states pass a Constitutional amendment providing for marriage equality.

Out of these four options which do you think is more likely? And out of these four options which can the "holy trinity" possibly effect?

I am absolutely gutted by this. I am holding out hope that the provisional and absentee ballots will turn the tide, but it isn't likely. Who says discrimination isn't alive and kicking in California? My fingers crossed that the next time this comes up, the population will vote to legalize gay marriage and change the CA constitution.
