3) the bill still has to go through the House, so even though it is likely to pass it isn't final

4) it seems like people writing here don't really understand what a filibuster is, you cant filibuster if there is a supreme majority. (three fifths of the senate) supreme majority invokes cloture, or causes the debate to close automatically.
