Gee� Do you suppose that its possible that his attorney determined that the tape would only incriminate his client further and thus never requested it?... (Or are we obligated to assume this punk is innocent even after being found guilty by a jury of his peers?...)

Seriously, this guy must've had a crappy lawyer. This incident happened less than 3 months ago. Did he/she do any discovery or interviews with the cops or bystanders?

I can tell you that the video was played for the jury multiple times. There was only witness that came forward besides the suspects and added nothing to the night's events besides what was on the video already. Bottom line is: if you witness something like this and are bothered by it--COME FORWARD AND TESTIFY! The fact that there were apparent "witnesses" to the event and no one came forward with a statement ruined Hays' case.

i was dismissed from the jury during voir dire. fwiw, his lawyer was pretty young and admitted to the bar in the last 3 years (i looked it up). the prosecutor seemed pretty experienced and polished.

Wait -- you mean, the Stranger was wrong about a "police brutality" case again? Shocking.

I think if you end up getting charged with assaulting a cop, the last thing you want to do is get the Stranger on the case. At that point it's pretty much guaranteed you'll get convicted.
