It would not surprise me at all to find out that China has much more restrictive public-photography laws than we do. This video would be completely legal in the US, but in China someone may be going to jail.

@7: "Reasonable expectation of privacy" does NOT cover makeout sessions in public transportation. You can't hijack a public space and make it private just by doing something that would ordinarily be done in a private place.

I got in about 40 seconds before I was too bored. Is that all it is, them making out? First of all, why did anyone watch it to begin with? Second of all, who cares? If they have a legal ground to stand on with this, I'm disappointed in laws.

There are almost certainly surveillance cameras in the subway, too, plus the fact that it's a public space, so they reasonably could not expect this to be "private." If you are outside of your house, you have no expectation of privacy when it comes to public displays of affection, or asshattery, or whatever you are doing. Seriously. If you're doing something you wouldn't be okay with other people knowing about, DON'T DO IT IN PUBLIC. Period.

This is much different than up-the-skirt filming - which is violative because it is for one party's sexual gratification without the consent of the filmed party - and I think comparing the two is disingenous.

Taking an upskirt vid goes one step beyond what the subject is consensually sharing with the public. There isn't much more that this couple is hiding, I think.

@10: Very true, and it wouldn't be the first time I was disappointed in laws, by any means. That privacy is difficult to obtain does not put the onus of respecting private moments in public spaces on other people sharing those public spaces.

@11: That is different, and I think you understand how, but to clarify - If you wear a skirt that is "modest" with normal movement and wear, and sit in manners becoming of a lady, then it's reasonable to expect people not to use technology or mirrors or whatever to look up your skirt without your consent. These people are making out in a very public place, and not taking any reasonable steps to keep that private.

They obviously have no reasonable expectation of privacy there. C'mon people! They are probably just embarrassed because the subway workers were laughing their asses off at them!
