Would someone please enumerate for me, what exactly are the constitional rights that the Bush administration has eroded? I can only count one: Habeas corpus in regard to inmates at Guantanemo and other individuals. I agree, that's very bad.
Wiretapping incoming foreign calls to suspected terrorist cells and other police work is not exactly eroding our rights, especially if they took the right steps with the FISA court. Also, there has been few, if none, civil cases brought because of the Patriot act.
No, I don't love 'W but it seems to me that if the Democrats win the White House they will want to keep the Patriot Act in place as the next president will get the briefing that will scare the hell out of her as to the daily terrorism threats.

the whole point of the wiretapping scandal was that the Administration was not using the FISA court's safeguards lax as they are. Bush & co. were simply trolling through broad swaths of data and calls with out any probable cause at all, and without going to a judge for permission either before or after. Clearly this was illegal, but congress cravenly allowed it.
And it is a violation of our constitutional privacy rights. you could also argue that Bush's use of signing statements unconstitutionally broadens the power of the executive thereby weakening Congress and the separation of powers
Also it is conceivable that the Bush administration has tortured legal residents of the US violating the prohibition of cruel and unusual punishment.

There's something about Congress having the power to declare war, not the President. Oh, and I think Article VI says when a treaty is ratified it becomes the supreme law of the land; you can't just ignore treaties you don't like. Even if you're the President.
There's also no religious test for public office. Same Article, number six-o. When the President was tolerating members of our armed forces such as the Air Force Acadamy cadets to who demanded Christian oaths of their subordinates, he was letting the Constitution be eroded.
That's a couple off the top of my head. Want more? Like intimidating critics of the war and the administration? More? Like that torture is indeed cruel and unusual? More?
