if you read the dissenting opinion (am I a huge nerd? guess so) you'll see that almost every other circuit has already ruled that much less intrusive searches (e.g., strip search by the mother) with better evidence (student told administrators girl had planned to hide marijuana in her pants) for worse crimes (marijuana vs. ibuprofen) had been ruled impermissible.
2nd and 4th for sure, various others implied.
So 9th isn't always the best; oh well.
The judges probably thought that was hot. Pervos.
more conservative judges might be freaked at the "violation of young womanhood" thing -
and see daughters and grand daughters being stripped
just a thought
Also, re: the latter... yeah, you can't do that in a student paper. Sure, we ideally should have freedom of speech and all, but it's a student paper and we know the M.O. at schools.
Strip-searching *anyone* because they might be concealing -- concealing! -- Ibuprofen?
Ibuprofen? Last I checked, the worst a little Advil did was take the edge off a headache.
This happened in the U.S., right?
