Question, if Cheney does not get indited before Bush leaves office, can Bush still give him a pardon?
Bush can pardon him any time he wants regardless of what happens to Cheney. Hell, unless Bush gets indicted for something he could pardon Cheney too. As long as he's the president he can pardon anyone he wants. He could pardon Charles Manson if he wanted to.

I'd rather that Bush has to pardon Libby from a jail cell, not before Libby's served even a day.
Libby is going to a federal pen with a tv, internet access, and dorm style housing. any jokes about him being raped in prison just dont apply. i fail to see why people still think prison rape is funny, but ok. he will prolly bet put on PC as soon as he gets in. hell, he will prolly be allowed to ride his scooter. regardless, this is good news. i only hope they have the guts to go after Cheney.
So, Cheney, who has not been charged with a crime, can receive a preemptive pardon from GW. That is seriously fucked up.

Bush and Cheney will co-sign an executive order that all prison TVs must be tuned to FOX News.
Cheney can be pardoned for a crime even if he hasn't been indicted - or charged - for it.
But the problem is anticipating all possible charges.
Does he have to report or will he be free pending apeal?
@11, Libby will be free until next week, at least. Next week the judge will decide if he goes to jail then, or gets to walk free pending (inevitable) appeal(s).
So, in other words, he won't spend one f-ing minute in jail.

Will, if Cheney is half as smart as he is evil, he has a big list of every crime he could possibly be charged with from the past millennium (he is immortal, right?) and all GW has to do is sign on the dotted line.
