Washington State Gay Marriage Decision Coming Before the September Primary

Posted by on July 19 at 16:00 PM

Via the Associated Press:

SEATTLE — Supreme Court Justice Susan Owens said today that the court’s long-awaited ruling on the constitutionality of the state’s gay marriage ban will be issued before this September’s primary, contrary to rampant speculation that the justices would hold off because of the topic’s sensitivity.

This news increases the odds that the decision is against gay marriage. The speculation was that the liberal court was delaying the announcement of an unpopular decision in favor of gay marriage would hurt Democrats.

I wonder who Bush had to betray to get that decision?

Speculation is just...well, speculation. I can speculate that the court doesn't take politics and the timing of legislative elections into account when deciding when to issue decisions, and that's just as valid.

Personally I hope for the Vermont style-tell the leg to do something approach with the leg doing Civil Unions. CU are much more palatable to people then full marriage. While I would love full marriage for my gay and lesbian friends I do not want it at the expense of a liberal supreme court, or a liberal state leg.

However, Ideally I would prefer a total leg solution. Judicial fiat has a mixed track record when it comes to changing society. For every success like desegregation (which is mixed at best) there are failures like abortion.
